1. About these terms
These terms and conditions apply to your use of the Yarraville Storage website and to enquiries you make about our storage services. References to "we", "us" and "our" mean Yarraville Storage, based in Yarraville, VIC, Australia.
If you book storage with us, you will also be asked to agree to a storage agreement. That agreement contains the detailed terms of your storage. If there is any inconsistency between these website terms and your storage agreement, the storage agreement prevails for the storage services it covers.
2. Using our website
You may use this website for lawful purposes only. You must not misuse it, attempt to gain unauthorised access to it, interfere with its operation, or submit false or misleading information through our forms.
The content on this website, including text, images, logos and design, is owned by us or used with permission. You may view and print pages for your own personal use in connection with a storage enquiry, but you must not copy, reproduce or republish our content for other purposes without our written permission.
We aim to keep the information on this website accurate and up to date, but we do not guarantee that it is complete or free from error. Photos are illustrative and may not show the exact bay or space you are allocated. Our website may link to third-party sites; we are not responsible for their content.
3. Quotes, enquiries and bookings
Submitting an enquiry or quote request through our website does not create a booking or a contract for storage. A quote is an estimate based on the information you give us and is subject to space being available.
A booking is only confirmed once we have confirmed it with you and the storage agreement has been agreed. We may decline an enquiry or booking, for example where we do not have suitable space or the item you wish to store is not something we can accept.
4. Storage services
We provide outdoor and under-shed storage for vehicles, shipping containers and equipment and machinery. In general:
- you must tell us accurately what you intend to store, including its type and approximate size, so we can allocate a suitable space;
- you must own the goods or have the owner's authority to store them;
- you must not store illegal items, or items that are dangerous, flammable, hazardous or otherwise not permitted under your storage agreement or by law;
- you must comply with site rules, access arrangements and reasonable directions from our staff;
- you must not use the space for any purpose other than storage, or allow anyone to live or work in it.
Access hours, site rules and other operational details will be provided when you book and may be updated from time to time.
5. Fees and payment
Storage fees are set out in your quote or storage agreement. Unless your agreement says otherwise, storage is offered on a flexible month-to-month basis. Fees are payable as set out in your storage agreement.
If fees are not paid on time, we may take the steps described in your storage agreement. Depending on that agreement and the law, these steps may include charging fees for late payment, restricting access to your stored goods and, after giving you proper notice, dealing with or selling the goods to recover what is owed.
6. Your goods and insurance
Goods are stored at the owner's risk. We recommend that you keep your own insurance in place and check with your insurer that your goods are covered while in storage. We take reasonable care of the storage site, but we do not insure your goods unless we have agreed otherwise in writing.
7. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded.
Subject to that, and to the extent the law allows, we are not liable for loss or damage to goods stored with us that results from causes outside our reasonable control, or for indirect or consequential loss. Where the law permits us to limit our liability for a breach of a consumer guarantee, our liability is limited to resupplying the services or paying the cost of having them resupplied.
We are not responsible for any loss you suffer from your use of, or inability to use, this website, except to the extent that liability cannot be excluded by law.
8. Privacy
We collect and handle your personal information as described in our Privacy Policy.
9. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of this page shows when they were last changed. By continuing to use our website after a change, you accept the updated terms. Changes do not affect a storage agreement you have already entered into unless that agreement says so.
10. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
